General conditions of sale

It is hereby stated that these terms and conditions govern the sales of all products in the EUROPE TRADING CARD GAME Online Store. These terms and conditions apply to the exclusion of all other terms and conditions. Hereinafter, EUROPE TRADING CARD GAME will be abbreviated as EUROPE TCG.

ARTICLE 1 – PRICE OF ITEMS AND TAXES

1.1 - The prices of our products are indicated in Euros, all taxes included, excluding processing and shipping costs. Prices are not negotiable.

1.2 - All orders, regardless of their origin, are payable in Euros.
1.3 – EUROPE TCG reserves the right to modify its prices at any time without having to notify customers. However, products will be invoiced on the basis of the prices in effect at the time of order registration, subject to product availability. The products remain the property of EUROPE TCG until full payment of the price.
1.4. The products remain the property of EUROPE TCG until full payment of the price and their collection by the Post Office, either by direct collection by the Post Office or by deposit by our services at the Post Office.

ARTICLE 2 – ORDER FROM SASU EUROPE TRADING CARD GAME
The contractual information is presented in French and will be the subject of a confirmation including this contractual information at the latest at the time of delivery.
EUROPE TCG reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

ARTICLE 3 - VALIDATION
The data recorded by EUROPE TCG constitutes proof of all transactions between EUROPE TCG and its customers.
The data recorded by the payment system constitutes proof of financial transactions.

ARTICLE 4 – AVAILABILITY OF ARTICLES
Our product offers and prices are valid as long as they are visible on the site, while stocks last.
You have 5 days to send us the payment, otherwise the order will be cancelled to allow the reserved products to be put back on sale.
Our offers are subject to availability from our suppliers. We do not guarantee product availability for all payment methods.
If a stock shortage occurs, we will offer you a solution that suits both parties.

ARTICLE 5 – DELIVERY OF ITEMS
The products are delivered to the delivery address indicated by the buyer during the ordering process.
In the case of items that are delivered on different dates due to their availability, the delivery time is based on the longest delivery time. This means that in the case of an order containing pre-ordered products, it will be delivered when the pre-ordered product is available. Europe TCG will ship orders, except in exceptional cases, within 72 hours of confirmed receipt of payment (excluding weekends and public holidays).

EUROPE TCG cannot be held responsible for the consequences of late delivery.

Shipping is free for France for purchases over €100 and for European Union countries for purchases over €1,000. Shipments will be made in the same package if pre-ordered items have different release dates when the last pre-ordered item is released.

EUROPE TCG is not responsible for any problems related to the delivery of the order. The buyer is solely responsible for the risk. All our items are shipped by registered mail, which allows the buyer to have access to insured delivery. In the event of non-receipt of an uninsured item, the customer will not be entitled to any compensation from EUROPE TCG. In the event of a postal problem, we undertake to take all necessary steps with La Poste to facilitate the search for the package or its compensation, if applicable.

ARTICLE 6 - PAYMENT
Payment for your purchases is made by Paypal or by bank check for postal delivery.
In case of payment by check, shipment will only be made after the check has been cashed.
In the case of handovers, only cash payments are accepted.

ARTICLE 7 - REIMBURSEMENT
7.1 - You have the right to return, exchange or refund any products that do not suit you within 14 clear days of delivery of your order, without penalty, except for return costs (this clause does not apply to sets of cards and/or individual cards and/or products on sale). Returns must be made to EUROPE TCG 4 chemin du mas 16360 CONDEON.
7.2 - Items returned incomplete, opened, damaged, damaged or soiled by the customer will not be accepted.
7.3 - We undertake to refund or exchange any products that do not correspond to your order (defective or non-compliant). In this case, please provide a detailed description on the order form and return the product(s) to us. Europe TCG will exchange or refund the product(s).
7.4 - These refunds will be made within 15 days of our receipt of the products. The refund will be made at the discretion of Europe TCG by crediting your bank account in the name of the customer who placed the order and to the billing address.

ARTICLE 9 - LIABILITY
The products offered comply with current French legislation. Europe TCG cannot be held liable for any failure to comply with the legislation of the country where the product is delivered (prohibition of a title, etc.). It is your responsibility to check with local authorities regarding the possibilities of importing or using the products or services you plan to order.
The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, Europe TCG cannot be held liable in the event of an error in one of these photographs or texts.
Europe TCG cannot be held responsible for non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire.
Europe TCG shall not be liable for any indirect damages arising from this Agreement, including loss of business, loss of profit, loss of opportunity, damages or costs.

ARTICLE 10 - PRE-ORDERS

All pre-order orders are final and binding. No cancellations will be accepted on these orders.

ARTICLE 11 - APPLICABLE LAW AND DISPUTES
This contract is subject to French law.
The language of this contract is French.
In the event of a dispute, the French courts will have sole jurisdiction.

ARTICLE 12 - PERSONAL INFORMATION
Europe TCG undertakes not to disclose to third parties the information you provide. This information is confidential. It will only be used by its internal departments to process your order and to strengthen and personalize the communication and product offering reserved for Europe TCG customers. Consequently, in accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose any personal data concerning you.
